How Many Cigarettes Can You Bring from the UK Duty-Free? 2026 Allowances

Travelling back from the UK by plane, ferry or car and want to bring cigarettes? The allowance for a traveller entering Poland from a country outside the European Union — and the UK has been a third country since Brexit — is 200 cigarettes, or 100 cigarillos, or 50 cigars, or 250 g of smoking tobacco. You can also mix these products, provided the combined proportion does not exceed 100% of the permitted quantity. The allowance applies to personal use only — goods intended for resale do not qualify for the exemption and are subject to full customs duty and excise even in small quantities. If you exceed the permitted amounts, a KAS (National Revenue Administration) officer is entitled to seize the excess and issue a fine or open fiscal-offence proceedings. Below you will find the exact rules, a table of allowances, rules for e-liquids and tips on how to avoid border problems.

Tobacco product allowances from the UK — what you may bring duty-free

Poland has applied allowances derived from Directive 2007/74/EC and national regulations for travellers arriving from outside the EU since 2020. The UK has been a third country since 1 January 2021, so every PL–UK border crossing (or return from the UK via another EU state) is subject to the same rules as arriving from the USA or Turkey. Below you will find the current allowances for an adult (over 17) travelling by air, sea or land.

Allowances for cigarettes, tobacco, cigars and e-liquids

<p>Quantities permitted duty- and excise-free (personal use, adult traveller, entering Poland from the UK):</p><ul><li><strong>Cigarettes:</strong> 200</li><li><strong>Cigarillos (cigars up to 3 g):</strong> 100</li><li><strong>Cigars:</strong> 50</li><li><strong>Smoking tobacco:</strong> 250 g</li><li><strong>Heated tobacco products (HTP):</strong> 250 g (treated as smoking tobacco)</li></ul><p>You may mix products, but the sum of proportions must not exceed 100%. Example: 100 cigarettes (50% of the allowance) plus 125 g of tobacco (50% of the allowance) equals exactly 100% — within the limit. An additional 10 cigarettes or 10 g of tobacco would exceed it.</p><p><strong>E-liquids (vaping fluid):</strong> Poland has not introduced a separate quantitative allowance for e-liquids as a traveller category — however, nicotine-containing fluid is an excise product. Bring nicotine liquid with caution: commercial imports require declaration. Check the current KAS position at podatki.gov.pl/akcyza.</p><p>Verified as at 2026-04-18. Contact a customs broker before taking action.</p>

Children and young people — no exemption under 17

<p>The tobacco allowance applies only to persons who have turned 17 on the day of crossing the border. A KAS officer may check the identity of anyone claiming the tobacco exemption and refuse it to a minor. Parents or guardians cannot pool a child's allowance with their own — each adult has an individual allowance.</p><p>If you are travelling in a group (e.g. a coach trip or a family of several adults), each adult may bring 200 cigarettes for their own use. However, it is not permitted to pool the individual allowances of several people for the purpose of resale — KAS treats this as excise smuggling.</p>

Travelling via another EU country — does the allowance change?

<p>If you fly from the UK to Poland with a connection in Germany or the Netherlands, your traveller status does not change — you are still entering from a third country and the 200-cigarette allowance applies. Customs clearance takes place at the first port of entry into the EU (e.g. Frankfurt or Amsterdam), but in practice for intra-EU travel the inspection happens at the Polish border.</p><p>If you buy cigarettes in duty-free at a UK airport (e.g. Heathrow), check on the packaging whether they are intended for export — UK duty-free sales to travellers on routes to EU countries are permitted, but they are subject to Polish import limits on the PL side. Buying more than 200 in duty-free and bringing them to Poland means you exceed the allowance and risk confiscation of the excess.</p>

Penalties for exceeding the cigarette allowance from the UK

Exceeding the tobacco allowance is not automatically a criminal offence — but it can become one if the quantity suggests a commercial purpose. KAS applies the principle of proportionality: for one pack over the limit you will receive a caution; for 10 cartons you face the Fiscal Penal Code. Before you pack your case, it is worth knowing the exact consequences — especially if you travel frequently between Poland and the UK.

Fine and forfeiture of goods for minor excess

<p>For a minor excess (usually up to approximately 50% above the limit), a KAS officer may apply a penalty notice under Article 138 § 1 of the Fiscal Penal Code and limit the action to seizing the excess. The fine ranges from 1/10 to 5 times the minimum wage — in 2026 the minimum wage is PLN 4,666 gross, so the fine can range from approximately PLN 467 to over PLN 23,000.</p><p>Seized cigarettes are forfeited to the State Treasury — there is no possibility of recovering or buying them back. A seizure receipt does not constitute proof that you may bring them in on a subsequent crossing.</p>

Fiscal criminal proceedings for large quantities

<p>If the quantity of cigarettes or other tobacco products indicates a commercial purpose (KAS uses an indicative threshold of above 800 cigarettes or equivalent other products), preparatory proceedings are initiated under the Fiscal Penal Code. A fine is imposed, and in extreme cases imprisonment of up to 3 years (Article 63 FPC — excise smuggling).</p><p>The vehicle used to transport the cigarettes may be impounded as an instrument of the offence pending investigation. If you are a professional haulier, the case goes to the customs-fiscal office and may result in the revocation of your licence.</p><p>This article reflects the legal position as at 2026-04-18. Contact a customs broker before taking action.</p>

Practical tips — how to bring tobacco products from the UK safely

Knowing the allowances is half the battle — the other half is proper conduct at the border and during customs-fiscal checks. Below you will find specific guidance for private travellers and professional drivers returning from the UK who carry cigarettes for personal use. Easy Clearance answers customs questions — if you have any doubts about the customs status of goods you are bringing, call us before you cross the border.

What to declare at the border and how to document it

<p>If you are bringing tobacco products within the allowance, you do not need to declare them at the border — the traveller allowance is a statutory exemption, not a customs procedure requiring documentation. You simply need to have no more than the permitted quantity on you and the cigarettes must be for personal use.</p><p>Problems arise when: (1) you have original bulk packaging (e.g. cartons of 10 packs) — KAS may treat this as a commercial indicator; (2) you have receipts or invoices for large quantities; (3) cigarettes are concealed in luggage in a way that might suggest an attempt to hide them. Recommendation: carry cigarettes in hand luggage or checked baggage in original retail packaging; do not hide them in compartments.</p>

Duty-free purchases at UK airports — what to check before paying

<p>Duty-free shops at UK airports sell cigarettes without the excise duty applicable in the UK — but this does not mean you can bring as many as you buy to Poland. The shop will sell you two cartons (400 cigarettes) without warning, even though that is twice your Polish traveller allowance.</p><p>Before you pay: check whether the total quantity is within the 200-cigarette limit. A duty-free shop receipt is not a document that exempts you from customs and excise obligations on the Polish side — KAS does not recognise a duty-free purchase as a basis for bringing in more than the allowance.</p><p>If you fly between Poland and the UK several times a month (e.g. as a cross-border worker), remember that the allowance applies on each entry — you cannot accumulate allowances between trips.</p>

HGV drivers and hauliers — cigarettes as personal luggage

<p>Professional drivers returning from the UK are entitled to the same tobacco allowance as tourists — 200 cigarettes for personal use. However, because of the frequency of their crossings (sometimes several times a week) and their professional environment, they are more often checked by KAS for excise smuggling.</p><p>Safety rule for drivers: travel with a receipt or invoice for cigarettes purchased in the UK (date, quantity, amount) and keep them in the cab in a visible place. If you have questions about what you can legally carry on a given route and crossing frequency, consult a customs broker. Easy Clearance accepts enquiries via WhatsApp and telephone, and you receive an answer within minutes.</p>

What the current rules say

The cigarette allowance from the UK to Poland is 200 cigarettes (or the equivalent in other tobacco products) per adult — the UK is a third country after Brexit and the same rules apply as for arriving from the USA or Turkey. Exceeding the allowance risks a fiscal penalty notice, forfeiture of the goods, and — for large quantities — fiscal criminal proceedings. Before each duty-free purchase, verify the current legal position at podatki.gov.pl, as excise regulations may change.

FAQ — frequently asked questions

How many cigarettes can I bring from the UK to Poland without paying duty?

200 cigarettes, or 100 cigarillos, or 50 cigars, or 250 g of tobacco — per adult (over 17). You may mix products, provided the combined proportion does not exceed 100% of the allowance. The UK is a third country after Brexit, so the same rules apply as when arriving from the USA.

What happens if I bring more cigarettes than the allowance?

A KAS officer may seize the excess and issue a fiscal penalty notice. For large quantities indicating a commercial purpose, fiscal criminal proceedings are possible under Article 63 FPC. Seized cigarettes are forfeited to the State Treasury.

Can I buy 2 cartons in duty-free at a UK airport and bring them to Poland?

No — two cartons is 400 cigarettes, twice the 200-cigarette limit. A duty-free purchase does not exempt you from Polish excise obligations on the PL side. The shop will sell you more, but KAS is entitled to seize the excess.

Does the cigarette allowance also cover e-cigarettes and heated tobacco?

Heated tobacco products (HTP, e.g. IQOS) fall within the 250 g tobacco allowance. Nicotine e-liquids are treated as excise products — there is no separate traveller allowance, but commercial imports require declaration. Check the current KAS position at podatki.gov.pl/akcyza.

Does an HGV driver have the same allowance as a tourist?

Yes — professional drivers have the same 200-cigarette allowance for personal use. Due to crossing frequency they are checked more often. It is advisable to keep a receipt for cigarettes purchased in the UK and store them visibly in the cab.
